Terms of Service

These Terms of Service (the “Terms”) govern the use of the website winemine.bg (the “Site”), the purchase of products through the Site, and the related services offered by WineMine. By placing an order or creating an account you confirm that you have read, understood and accepted these Terms.

1. Definitions

  • “Seller” / “We” / “WineMine”: CSM DISTRIBUTION EUROPA OOD, EIK 208086149, VAT BG208086149, registered seat: 85 Ekzarh Yosif Str., Oborishte district, Sofia 1000, Bulgaria, represented by Sebastian Daniel Klaus Wahl.
  • “Bar”: the WineMine wine bar located at ул. „Свети Климент Охридски“ 33, София 1504.
  • “Customer” / “You”: any natural person aged 18 or over, or legal person, who uses the Site or places an order.
  • “Consumer”: a Customer who acts outside the scope of their trade, business, craft or profession, within the meaning of the Bulgarian Consumer Protection Act (ЗЗП).
  • “Products”: the wines, sparkling wines, champagnes, spirits and related goods listed on the Site.
  • “Order”: a request submitted by the Customer through the Site to purchase Products.

3. Formation of the contract

The display of Products on the Site is an invitation to treat, not a binding offer. A binding contract is formed only when WineMine sends the Customer an order confirmation by email after the Order has been received and verified, including age verification (see clause 8). WineMine reserves the right to refuse or cancel any Order, in particular where stock is unavailable, where pricing is incorrect, or where the Customer’s age cannot be confirmed.

4. Pricing and VAT

Prices are displayed in EUR and include all applicable Bulgarian taxes, including VAT where applicable. Delivery costs are calculated separately and shown before checkout. WineMine may change prices at any time, but the price binding on a contract is the one shown at the moment the Order is confirmed.

5. Payment

Accepted payment methods: card via Shopify Payments. Card payments are processed by our payment provider; WineMine does not store full card data. Bank transfer and cash on delivery are not currently offered.

6. Delivery

Delivery terms, areas, costs and timeframes are set out in our Shipping Policy, which forms part of these Terms.

7. Right of withdrawal (14 days)

Consumers have the right to withdraw from a distance contract within 14 days of receipt of the Products, without giving any reason, under art. 50 of the Consumer Protection Act (ЗЗП). The procedure, conditions, and refund timeframe are described in our Refund / Return Policy. Returns of opened, damaged or unsealed alcoholic beverages cannot be accepted on hygiene and product-integrity grounds, except where the Product was defective or damaged on arrival.

8. Alcohol, 18+ rule

WineMine sells alcoholic beverages. In accordance with art. 54 of the Health Act (Закон за здравето) and the Wine and Spirit Drinks Act (Закон за виното и спиртните напитки), the sale and supply of alcoholic beverages to persons under 18 is prohibited. By placing an Order you confirm that you are at least 18 years old. The courier is entitled to request a valid photo ID at the moment of delivery and to refuse delivery if the recipient is, or appears to be, under 18 or visibly intoxicated. Where delivery is refused for these reasons, the Order may be cancelled and a return-shipping fee may be deducted from the refund.

9. Liability

WineMine is liable for non-conformity of the Products under the rules of the ЗЗП and the Obligations and Contracts Act (ЗЗД). To the extent permitted by law, WineMine is not liable for indirect or consequential damage, loss of profit, or damage caused by improper storage or consumption of the Products by the Customer after delivery. Nothing in these Terms limits any statutory rights that cannot be excluded under Bulgarian law.

10. Intellectual property

All content on the Site, including text, photographs, logos, graphic design, the WineMine name, and the curated product descriptions, is owned by WineMine or its licensors and is protected by copyright and trademark law. You may view and download content for personal, non-commercial use only. Any other use, including reproduction, redistribution or scraping, requires our prior written consent.

11. Accounts and suspension

Customer accounts are provided through Shopify customer accounts. You are responsible for keeping your login credentials confidential and for all activity under your account. WineMine may suspend or terminate an account where the Customer breaches these Terms, attempts to circumvent the 18+ rule, abuses promotions, or engages in fraudulent activity.

12. Complaints, KZP and ODR

You may submit a complaint by email to bar@winemine.bg. We will acknowledge complaints within 7 days and respond on the substance within 30 days.

If a dispute is not resolved, Consumers may approach the Bulgarian Commission for Consumer Protection (Комисия за защита на потребителите, KZP):

13. Governing law and jurisdiction

These Terms are governed by Bulgarian law. Mandatory consumer-protection rules of the Consumer’s country of habitual residence within the EU continue to apply. Disputes are subject to the jurisdiction of the competent Bulgarian courts, without prejudice to the Consumer’s statutory right to bring proceedings in the courts of their habitual residence.

14. Changes

WineMine may update these Terms from time to time. The version applicable to a given Order is the one published on the Site at the moment the Order is confirmed. Material changes will be notified via the Site or by email to registered Customers.
